In the absence of nda

Hi,

In a business (CAD model job) between two companies, company  A  provides design(CAD Model) services to its client company B.

No IP clause is mentioned in the purchase order issued by company B to company A  and no IP clause is mentioned in the  invoice given  by company A to company B .Non disclosure agreement is not executed.

If company B try to trouble its service provider A  with a threat of breach of non disclosure, will the case stands in the court / arbitration?

If so within  how many years from the date of purchase order , company A can file a breach of NDA case againts company B.

Thanks in advance

Rajesh

in this situation, in the absence of non disclosure agreement, there is little A can do to counter the threat of B.  none of the companies can travel beyond their terms and condition of agreement.  however, if there are trade protocols that have been breached, an action can be suggested.
