Injection Order- Please suggest me

 

Dear Experts,

I am living in hyderabad with my family(rented house). we have a property(concrete building) in Guntur,AP in the name of my wife and it was registered in May 2010 from her father as a part of property share.

the story here is 8 years back my father in-law has given upper portion of this building to a family  with out any  lease agreement for the rent of Rs.3000. From last 3 years the tennant  is staying lonely with out his family and his wife and childrens staying some other place in guntur.They are not legally seperated.

From my side , i am seviorly suffering from disk problem and  unable to do the job here in hyderabad.Because of this reason i’ve quitted the job in Feb 2011. From Feb  2011 onwards we are asking them to vacate the house to occupy my self as u know that how costly to reside in a city with out a job.he asked us 2 months of notice to vacate the house in the month of Feb. .From April 2011 onwards,  he is keep on saying us that he will vacate by the end of  month and end of the month. In the last month  also we faced the same answer that he will vacate by month end i.e May 2011. At  May end he asked us 1 week of permission to stay by extending a week in this month..by taking his oral assurence we allowed him to stay for 1 week.after that he again asked for one more week, we also allowed by taking permission to allow us to do some necessory repairs as this property is 22 years old.

Day before yesterday, by stating these reasons i.e 1) house repair    2) mental harrasment  we have been received a Ingection order from Judiciary court from  Guntur.

Please suggest me

My health is going very worst from day to day.

It’s vary hard to live here in Hyderabad by expending Rs 25000 for month.

I've to join my 4 yers old kid in a school

Without due process of law you cannot get him vacated. He seems to have filed civil suit but you will have to file rent suit on the ground of bonafide requirement;but in any case  it will be difficult for you to get the premises.without waiting further file suit and wait.or pay him money.

Thank you.

Am i able to file rent suit on basis of below grounds 

1) i have quitted the job- i dont have any income here in hyderabad from March onwards

2) My health is bad and iam unfit to do a job.

3)I have 4 years kid - Needs to join in school immediately

4) He is not paying rent regularly (he does n't have any rental receipts or bank slip for rental payments)

 

please let me know.
