I and my wife seperated for 1.5 years and I filed for restitution in Dec. 2012. Still this is running.
Frustrated with not able to close this in court or out of court even after atttending this around 10 times in court and series of counselling effort by court.
To add to my pain, I am denied with child access of my 3 year old son. Filed an IA for interim custody on August 2013. Again this case was heard last week and I could not get any response from court for my petition for interim custody and case will taken for next hearing in Mid of Dec. 2013.
Finally it looks like that I will get visitation rights to my kid or interim custody only after few more hearing which culd take another 6-12 months also.
Would you please advise about
1. Normal behaviour of interim child custody / visitation rights petitions and its closure time in kerala family courts.
2. Is there any way to get child visitation rights or interim custody quickly than this lengthy procedure of multiple court hearings?
3. Is there any criminal type of issues can be taken up sighting child safety, health and care?
