Is taking son from wife's custody termed as kidnapping/crime

Any good lawyer

Please elucidate a father is fighting a custody case for his son, Son is in the custody of mother (Custody had not yet been appointed by any court in favour of wife, when she left she ran away with my son), Son is 2.5 yrs old now

Q1) Can a father flee with his child from court premises ?

Q2) Whether any case can be registered in terms of father who is a kidnapper here ?

Q3) Is there any judgement on this, please provide the same ?

1. No a natural father cannot act against in asked manner which are against public order. 

2. Either natural parents cannot be charged under kidnapping based on facts if either cause to act in asked manner.

3. Several judgments are there.


Point here is meanwhile why donot you file urgency hearing Application for child visitation?
