Jurisdiction of district consumer foram

Dear All,

 

RTI Act is Central Act. As per RTI act the application seeking information may be sent to PIO/PA via registered post by any citizen of India.

 

Reply shall reach to the applicant within 30 days from the PIO/PA.

 

If information is denied without sufficietn reason is considered tha the PIO/PA failed to do service and on this ground applicant may approach Consumer Foram claiming deficiency of service.

 

My question is on the jurisdiction of Consumer Foram: the infomration shall reach the applicant where he lives and aslo the applicant asked for information using his right from the place where applicant lives. Hence can the applicant file complaint before the District Foram where he lives ....insted of filing the complaint before the District Foram where the PIO/PA lives...

  • A complainant had purchased a flight ticket in Jammu for a journey which was to start from Delhi to another city. The complainant filed a consumer complaint for deficiency of service against the Airline with the consumer forum at Jammu. The airline argued that the district forum at Jammu had no jurisdiction over this matter as no “cause of action” arose in Jammu because the journey for which the ticket was booked commenced from Delhi not Jammu. However, it was decided that that since the ticket was purchased in Jammu, the cause of action would arise in Jammu even though the journey was to commence from Delhi.
  • A complainant filed a complaint against a university before the Shimla District Forum. Though the university was located within the jurisdiction of another forum, the jurisdiction of the Shimla Forum was validated as part of the cause of action was considered to have arisen in Shimla because the money for enrollment was sent to the university from Shimla and the result was sent to the complainant by the appellant at his residence in Shimla.
