Lease Confusion

Hello to all our learned experts,

I have been staying in an apartment taken on lease by my company from the landlord and further given to me. Now the problem is that the company is paying the rent to the landlord regularly but not paying the apartment maintenance charges to the society for the last 6 months. For this reason, instead of the society approaching my company for the maintenance, is threatening to bar my entry into the society until my company pays the dues. The society has got no association and no bye-laws. Can they do so??

Regards

Tushar

In the instant case, the issue of payment of maintainance entirely depends upon the terms of the  agreement betweenyou and the company. If the burden of payment is not on you as per the agreement then it is purely deceided by the agreement of Rent/lease between the Company and the Landlord in which case you have no onus .
