Legal Heir from Court

My Grandapa property where there are 7 children and grandama is alive, Grandapa died in 1988 and now it is 22 yrs gone.

We applied for Legal Heir Certificate in Thasildar office - Chennai and it is refused since it is more than 15 yrs and we have to get it in court and now I approached a lawyer and he is asking us to pay 3% value of the property to the Govt and obtain the legal heir certificate from court. Is this is the way or any other way is there to obtain legal heir certificate from court ? pls. help

well that 3% will be in form of court fess for obtaning legal heir certificate.

Your answer :- Yes,  3% will be in form of court fess for obtaning legal heir certificate, But u take other lawlyer opinion for this.

Instead of succession certificate you can file a civil suit for Declaration for declaring you owner in possession of property and in this way you can save 3% stamp duty .

May i know why you need a  "Legal Heir Certificate"?. Because Legal heir certificate is not need for dividing the movable or  immovable properties. the heirs can divided them self by a partition deed or by a family arrangement or as Mr lal sait file a  suit for declaration of title.

just ask for succesion certificate. you will get affixing rs 20 adesive court fee stamp.
