Maintainence

Hi,

I own a flat in Bangalore. There is a leakage from my bedroom and it is dripping in the basement ceiling where car park is there. I contacted plumber to get that repaired for 7000/-. My question is who will bear the cost, me or the flat association from the common fund. I feel this should be shared by all, as this is structural defect leading to leakage. But my other apartment owners are objecting and say that I should pay the same. Also the issue is water supply is stopped for all the bathroom due to only one check valve for the entire column of flats(there is four flat in the same column). Please help in giving information as to what Law says and what is the customary practice in these kind of situations.

It is mistake of the contractor if construction of the house was given to the contractor, if not engineer is liable for the defective construction.

Thanks for your response.

The issue now is both the builder, engineer or contractor are out of picture and not traceable. The repair needs to be effected urgently to supply water to all the 4 apartments and needs to decided who will legally bare the cost.
