Let me explain-

JMFC- Judicial Magistrate First Class

RCR- Restitution of Conjugal Rights.

                       I can understand the confusions of a layman in the matter of law and procedure of the court particularly if you are handling your cases all alone. Ask your previous lawyer to give you a little time and guide you a little bit and show him the draft before submitting in the court so that he can make the necessary corrections. 

                       If it is an interim order of maintainance u/s. 125 crpc passed by the JMFC, then you will have to file a revision petition against the order within 90 days from the date of the order u/s. 397 of the crpc in the Sessions Court ( Again I repeat it should be filed in the Thane Sessions Court and not Bombay High Court ).

Thank you Adv. Archana.

It is an interim maintenance order passed by JMFC. The order was passed on 11th March 2013 but there was a delay from the court and so I had received the order on 12th April 2013. The court stamp is punched on the order mentioning the date as 12th april. So, as you said, I should appeal at the Thane Sessions court before 12th July 2013.... right ???  Kindly confirm !!!!!!

You are again confusing between appeal and revision. They both are different. If the order of interim maintainance is passed u/s. 125 crpc then, a revision petition is maintainable and not appeal. And the limitation for filing a revision peition is 90 days from the date of order.

My motto is to fight till the end to wave off maintenance passed in her favour. Can you tell me the difference between an appeal and revision petition for maintenance. According to me, as the name suggests, REVISION is to review the order passed bynthe lower court... Am i right ? Please correct me if i am wrong.

also, would like to know where to file petition for change in circumstances u/s 127 ?
