Official liquidation

I booked a flat in an under construction property in 2011. Till date company failed to give possession and now the company is in liquidation and official liquidator has taken over the symbolic possession. This project is a redevelopment project. OL few days back gave a paper notice for calling claims against the company. The company is not in position to pay for this claims, so are we the innocent flat buyers who have already denied possession from last 10 year's liable to pay this claims. Pls advise forward path

Understand the level playing with the builder and your individual limitations. The proper course is forming as a group of such all innocent buyers and fight for justice through a competent advocate. Make efforts in that direction of bringing all victims under one umbrella, pool some amounts and entrust this to a competent advocate, that can bring justice to you without the influence of the builder on him.

File your claim with relevant documents through a local prudent lawyer.

We engaged a lawyer in this and we are being asked to put some money in so as to get this project out of liquidation.

Everything may not be according to plans and if we wanted to get out of muddle one may have to spend some amounts to recover much larger amounts.  You may call it fate, destiny, or misfortunate as it happens only to some persons alone without their mistake. Law is such a thing and no one can expect justice without spending amounts and it is also not sure that only truth triumphs at the end.
