Partition suit

Mere Pita 5 bhai hai jinme se sabse bade uncle gujar chuke hai. Mere pita aur baaki 4 bhaio ne 1957 mai ek makaan kharida tha. Meri bhabhi ne partition suit file kiya hai jisme property ka batwara karne ki maang rakhi hai. iske alawa mere 2 uncle ne apne 2/5 share meri bhabhi ko bech diya tha aur koi plotting ya jagah chinhit nahi ki thi aur isme mere pita ki sehmati nahi thi. kya ye sale deed manya hogi.

Yes, undivided  share in property can be sold and such sale is perfectly  valid in eye of law.

Aapka reply karne ke liye dhanyawaad, mujhe is CS mai summon bhi nahi mila hai. Mai agli date mai applicaiton laga sakta hu judge sahab ke saame ki mujhe summon nahii mili aur plaint ki copy di jaye saath hi samay diya jaye reply file karne ke liye

If you know the details of the case and would like to participate in the suit even without the summons being served on you,  it would be better that you engage an advocate and file a vakalatnama,  after that your advocate can obtain the copy of plaint by filing copy application.

'Bhabhi' as the purchaser of the uncles' shares has filed the suit. You have no right or share in the property, your father being alive. Your father is a necessary party in the partition. He would have been served with summon or would be served in due course.
