Pf act applicability

Hello Everyone,

Greetings!!!

For an IT company which is three years old. In September, there were less than 15 employees in the company. Now there are 20 employees. In these 20 employees 5 employees are on probation period.

I just wanted to know, PF will be applicable in this company or not. Is it necessary to be registered in PF Act?

Kindly help me.

Dear Sachin,

Go through the provisions of PF Act and decide, if it is what I think then you need to have PF Act coverage. You have 20 employees...........

"Employee
An employee – sec. 2(f), means any employee who is employed for wages in any kind of
work, manual or otherwise, in or in connection with the work of an establishment, and
who gets wages directly or indirectly from the employer and includes any person"

If the management of the company refuses to register in EPF. Is it legal or disciplinary action can be taken?

You may read clauses

7 A, and C, 8, 14, and let your employer also go thru it.

Is your employer asking you to sign a declaration, email etc that your company does not need to subscribe? If yes, you may not.
