If you have signed the appointment letter mentioning notice period employer has the right to insist for notice period. Only option is to forego remuneration and other benefits. Don't attempt legal option as it will be detrimental to you.

Ther terms and conditions of your employment offer letter will speak on this.

If you are required to give one month notice period then you cannot avoid it because you have accepted the employment with the conditions and signed the offer letter.

Hoewever if you are allowed to buy the notice period by paying compensation, you can approach the company with your offer to pay compensation for the notice period that you are not able to serve on resignation.
