There are three proforma defendants in a suit for specific performance of contract against whom no relief is sought. However, these defendants have joint interest in plaintiff's claim. Plaintiff being a woman, no court fees was paid. One of the proforma defendants is a male person. I have doubt whether court fees has to be paid in such a case where proforma defendants have joint interest in the claim. Is this a curable defect if pointed out in a later stage? Please advise.
