I have agricultural land in Tamilnadu. It is cultivated by a person (calls himself cultivating tenant, though no agreement exist and is not paying tenancy rent, although his grandfather was a registered cultivating tenant for a different survey number of our property).
This tenant is not paying any tenancy rent nor giving any part of produce. Apart he has mortgaged the property to thirdparty without my knowledge and consent. He has also taken an ex-parte injunction against me, though the private suit was sent in a different name and address and by deceit, injuction obtained without me being heard.
I have filed suit for recovery of arrears of tenancy plus also requested for appointment of receivership to ensure the year's yeild is accounted for and my lawful dues are Paid.
My Query :
1. What are legal remedies available to ensure receivership is appointed at earliest. As this suit case drags on with adjournments and other reason, I am being denied lawful benefit. The tenant harvest the produce and is appropriating the full proceeds of cultivation when this suit hangs in court without any hearing.
2. What other legal remedies I can avail of
3. Would like advice on expert lawyer available in the state of Tamilnadu who can represent this case and expedite the sut.
