dear experts,
when there is partition suit settled by lok adalat and award is passed in jan2010. but after five months the S R IS completed and the parties are asked to pay challan for registering the award. after the huge payment in challan the original is submitted to section in court.lastly when the cmo went to registrar office , the registrar made certain objections like signatures of L.S.SECRETARY on all papers etc. we came back with cmo .now the councils say that for rectification it may take long time, & asked us to file petition under sec 151 of cpc for return of original challan. when the petition kept aside, they filed "out of order" to get it on bench. after one week when it came on bench the add chif judge says to pay additional amount by fresh challan and get registered privately and submit the copy to obtain the earlier challan.
1. the challan may expire in 120 days .already 90 days are over.
2.whether the challa if recieved later ,can it be encashed ?
3.how to go ahead in this matter ?
