Regarding writing petition

Sir,
I am presently working in a psb and wast promoted from clerk to officer and got transferred to bilaspur (chhattisgarh) although I filled panchkula as my choice but this circle was allocated to a person lower than me in merit list , so I filed a writ petition and court stayed the transfer orders and bank promoted me on the present place of posting only. Now I want to know that if I resign from my bank will bank recover the officer salary from me or not if the case will be pending at the time of my resignation.

If you have issued 90 days' notice and submitted resignation, the PSB is not entitled to recover from you such salary.  Even when such notice is not given, in general banks relieve such litigants immediately, and some may wish to retaliate and purposefully delay the relieving by stating some other reason.   No litigation issue is pending for the present. (I know some cases in PSB a resigned employee was relieved within a week and was garlanded also as he was a trouble maker)

No recovery could be effected on account of the pending litigation.
