Release deed

Hi,

My father got property from his father and he had 3 sisters and out of which 1 sister is dead (she has 5 childrens) and other 2 sisters are alive. Now we had a family discussion on property and 2 living sisters have agreed to sign the document to release their rights on the property.

1) Should we also get signature from dead sisters childrens as well?

2) Should we register the release deed in sub registrar office with all of the parties?

3) 2 of dead sisters childrens are abroad and one is ill, they might not be able to able to immediately come and sign in register office. How can we deal this situation legally?

Please suggest.

1. The registered release deed relinquishing their rights should be executed by the legal heirs of the deceased sister also. 

2. Yes.

3. They may authorise their relatives by a power of attorney deed to execute the registered release deed on their behalf.
