Salary holder and charging penalty

Hi,

I am working in a corporate company meanwhile when i was working I got interview call from a banking concern I just went and attended the interview alone and was not planning to join there , some how my manager came to know about that and he was cornering me and holded my salary every month 1st date I use to get my salary now the date is 11th Nov 2015 still I haven't got my salary , I explained the situations to my manager requesting him to release my salary and he was cheating me that he already sent mail but he wat he did was he sent a mail to HR that my performance and discipline was bad and he don't want me and accept my resignation were am not in a mood to resign. I excalated the call to the HR he was also helpless and I took it forward to the president of the company were he was telling I can leave the job  and I will be charged penalty were I was not resigned , now they charged some penalty still they didn't release my salary ,pls help wat should I do in these kind of cases.

Appearing in interview is not misconduct.Salary can not be withheld or penalty be charged without notice, proper opportunity of being heard and natural justice. Demand of resignation is offense and can be termed deemed termination. Download all emails that have been sent by you and also performance record NOW. Later you may not get anything.

 

Discuss with elders of the family and alongwith elders consult employee's/trade union leaders and an able Labor Law Consultant. You may escalate to MD as well, and narrate in a gentle language.

 

The earned wages if not paid by usual pay day then employer can be penalized.

 

Don't resign with immediate effect and until you have firtmed up next venture.Submit notice of resignation (even more than notice period narrated in appointment letter sday 90days) under proper acknowledgment.

 

Mark your attendance and downlaod attendance record.
