Salary not paid

Hi I was working with one of the BPO as a Manager from last 1.5 years , as I have got a better opportunity in another BPO , I have decided to resign by giving a proper notice period of 30 days a per the company policy. Hence I have given the resignation with 1 month of notice period which has ended on 3rd September , Our salary date was 1st of Every month & I was given a commitment that the August month salary will be processed & 3 days salary of September will go in F&F. But I have not received the salary for August till date , I am in continuous follow up for my salary but not getting any positive response & they said that it will be paid during F&F after 45 days.

I agreed to it now I will be completing 45 days by 18 October but still I am not getting any positive response from the HR or Management, Kindly suggest what can I do if I don't get a salary in 45 days as I have followed all the policy of the company & I resigned properly by giving 30 days of notice period attribution & they are saying that it can also take 90 days

Monthly wages are to be paid on usual pay day or as described in Shops and Commercial Act of the state, Payment of Wages Act, Minimum Wages Act.

FNF wages should be paid on last day in office or say with in 3 days or max. by usual pay day.

Who says it shall take 90 days? Record the transactions (audio/visual) keep witness and evidence.

Why just payment of wages, FNF statement, acceptance of resignation, Form 16 as per correct FNF statement, payment of FNF dues by bank DD, pay slip for all months, service certificate, relieving letter, PF number, PF a/c slips for whole tenure of service as issued by PF office, ESIC number/Card, NOC/NDC etc  should have handed over on last day in office………………….

>> Lawyer/Law firm: The legal notice by lawyer can drill sense into the heads.

>> Trade Unions, employee’s group/union/IC/Guild…………………..

>> O/o Labor Commissioner: labor Inspector………..

>> Inspector under Shops and Commercial Establishments Act of the State…………

>> Inspector under Payment of Wages Act ( Applicable to all employees drawing wages as per def. of wages in the Act  up to Rs.18000/pm)

2. Definitions………3*[(vi) "wages" means………………..(d) any sum which by reason of the termination of employment of the person employed is payable under any law, contract or instrument which provides for the payment of such sum, whether with or without deductions, but does not provide for the time within which the payment is to be made;

>> RPFC in o/o PF Commissioner

 

>> Inspector in Local/jurisdictional ESIC office………….
