Security Cheque- Dishonour Of

Kindly Provide the latest ruling on the Dishonour of the Security Cheque, whether Security Cheque deposited with the Bank attracts the Provision of Section 138 of N.I. Act more particularly when blank cheque is given ?

 Where cheques issued as security, on dishonour of such cheque, not offence under Sec.138 of the Act (2001 (2) RCR (Crl.) 75 MP) also see 2002 (3) Crimes 145 ( Raj).

There are various latest judgments also of supreme court that cheque issued as security did not attract provisions of 138. But ur counsel have to search the same.

U/S.138 Negotiable Instrument Act itself stated that cheque issued only for discharge of liability.
