Substitution of complainant

Page no : 2

R Trivedi (advocate.dma@gmail.com)     31 January 2012

The matter pertaining to this case is somewhet different, a prop firm means prop as individual in legal eyes, case under S.138 of NI Act is holder specific, that means the complainant should have some involvement. In the present matter, the complaint was filed by an employee under some authority, the employee resigns and some other employee submits his affidavit as complainant affidavit, without permission or application for substitution. This seems dicey on the part of complainant.
