Hi all,

 

Can someone guide me in regards to following query:

If children/wife wants to separate out due to domestic violence ,do children/wife have any right on father's property that have beem bought after selling inherited property?

There are several factors that should be considered as to when were the children born, whether the property inherited by the father can be called as ancestral property or not and when was the property sold etc. Speaking in general, if the father have sold the ancestral property without seperating the share of the children and bought some property with it then, they can still claim their share (depending upon facts and circumstances of the case as there are many things to be considered).
