Survey number rectification

Sir/Madam,

My mother-in-law own's an agriculture land purchased in 1983 in Dhodballapur,Karnataka. Few years ago, during some survey she was told that her land survery number exchanged with the adjacent property and vice versa. This property was first given as a Dharkas to a person from whom she had purchase a part of that property after Podi. The first alloted survery # was 26 and after podi the surver# became 67 & 68. The one she own is Survery# 67 and in the sale deeds it is mentioned the same and also in the Akarbandh it says survery number 67 towards North. But, the catch is, in the survery sketch it is showing as 67 plot is to the south and 68 is to the North. 

When in 2005/06 the surveyors came to measure he said her Survery number is not 67 and is 68. 

We have not received any notice from the surveryor till date on the survery number mismatch and the adjacent property owner has given a GPA to some RealEstate Agent and has sold half the property to people in the area. We are still not sure how is the Akarbandh and Survery Sketch are mismatching and how can we get this corrected.

Why dont you go to the Surveyor's office and enquire? Do you mean to say in such matters there will be any off the shelf answer?  It is all practical on the ground matters.  Therefore better to the Surveyor's office and pursue.  If need be, get in touch with a local lawyer and discuss.

Saying, telling, told, asked are all verbal communications and difficult to establish.

The survey number got exchanged I verbal communication..

Try RTI route and get authenticated/certified copies and reply under popper seal and signature..

If you are unable to handle on your own approach your own very able senior LOCAL counsel of unshakable repute and integrity specializing in revenue matters and having successful track record ….. and worth his/her salt …for help and guidance.

 

Check at LOCAL office of Tehsildar/Civil courts for such counsels..

We wrote a letter to Tehsildar and have also asked the survery for a response to our letter but we haven't received any. The landlord who got our adjacet site on GPA had all control at the Taluk office and everyone there hesitate to guide us in a right way.. Everyone says if he wants to buy the property then sell it off to his then you will not have any problem..

The Landlord wants our property on GPA and we are not ready for it. 

We have consulted several lawyer and non so far talk in favor to us.. all are behind selling it off and get ride of the property.

The surveryor is in favor of the landlord who purchase the adjacent site and at taluk office when we are there everyone know who we are and what we have come for and non wants to help us. 

As is said our neighbour property #68 is sold as site to many people and in the survery sketch it shows its #is 67 but in his sale deed its #68 and vice versa for us.. 

Is this something that has to be corrected by DDLR? Thesildar once said it has to come through DDLR, but not sure if that is true..
