Tanent is not vacating the shop

Dear Sir,

I am resident of Uttar Pradesh, Kanpur, 7 year back we have purchased a house which was having 4 Shop, one of them continued to stay with the 11 month agreement. after every 11 month we renewed the agreement but from past 18 month he has not renewed the agreement and few month back he has stopped paying rent, rent amount is 1100 /pm only.Since past 12 year he is residing in our premises. earlier years his brother was running the shop and agreement is made of his brothers name, when his brother left the shop then the current party has started his book shop and agreement started by his name. he is having political influence and his relative is advocate so he always threatening neither to vacate shop nor will pay rent.

please help, now what could be the possible actionable.

If you are actual title holder with title documents then you can file a RCOP petition as against the tenent.  Before that you have to issue a legal notice through by your Legal adviser by RPAD stating all the reasons. If the reply is not satisfied then you can file RCOP as per your local laws. Being non payment of the rent itself is a valid point for vacating the tenent. Moreover the present ocupent himself cannot be treated as tenent as per your statement.
