I am an advocate, I would like to know about s c judgment or any high court judgment [regarding sub registrar did wrong spot inspection ] my clint purchased a residential property and registered it after registration sub registrar did wrong spot inspection and explained it as commercial inspite of residential and referenced the matter to d i g stamp for recovery in short stamps. d i g stamp issued a notice in the registration act 1908 section 51 to recovery in short stamps .
I replied to the notice of section 51 of the registration act 1908 that my clint is in defense service and on duty at the time of inspection ,so the sub registrar did the wrong spot inspection, so dismissed the notice. I would like to know any higher court judgment regarding the matter.
