THREAT FROM BUILDER

Our building has NO ADHOC COMMITTEEE/SOCIETY. It is run as a mutual committee formed within its building members.

Our builder has 7 flats and also made illegal srtucture on terrace for the use of embroidery workers, which he rents it for exhorbitant rates.

Now thatw e want to demolish it, he the builder has threatened to take action against us, if we propose demolishing it.

Apart from going to the police station for writing an NC what other legal steps can be taken so that when we demolish it, builder will not be able to do anything legally.

You have to file a suit for mandatory injunction against that person seeking order of the court to remove the illegal construction, but it is important to file this case within two years of the illegal construction. 

In such cases there will not be a completion certificate issued by the competent authority.  So take the benefit of that and file a suit.

U contect local lawyer and file a suit in court. Contect corporation and give one application for dimolish the illegal construction of the building.
