Transfer in desguise of company policy

Sir,

I have a query regarding the forced transfer by a Ltd. Company. I worked for more than 5 years as an accountant (Salary - 30000/- p.m.) in the company. Here is the chain of events :-

1. Sept. 2013 :- There was a heated argument on work related issue with my boss i.e HOD f&Accts.

2. Boss, who has personal issues with me blown out of proportion the issue and reported to management.

3. HR manager called me and said that management has decided to terminate your services, I explained my position to him, after which he hand over a written notice with prominance given to my workrelated matter and also mention the argument with boss in one line with asking for reasons in 24 hours why my services would not be terminated.

4. I have given the reply in writing with evidences like email and excel sheets to prove that charges leveled on me are completly baseless.

5. After one week, HR Manager called me and handover a transfer order letter said you have to report at our Banglore office with in Two days, as you transfered to Banglore office (Marketing Branch) as an Accountant.

6. I asked HR Manager about my reply against the notice, he said we have accepted your reply, and therefore we are transfering you to Banglore Marketing Branch, which you have to join in two days time.

7. I replied in writing that as i am an accountant, what will be my job reponsibilities in Banglore Marketing Office. Also I expressed my inability to join the Banglore office in such short time. I asked some time and asked for train ticket and intial accomodation for one month.

8. They did not provide any job profile in Banglore office, but extend time to seven more days. and also refused to provide accomodation for intial period.

9. Now I am sitting in my house for last one year and doing some part time jobs for my living as I have a family. HR Manager has asked me to submit the resignation and said that he has order of the management to terminate my services at all cost. He accepted in pvt. conversation that they have issued this transfer letter just to make pressure on me to resign for my services, which I have not done till date.

I, urge all the experts to help me, how can I fight this type of harrassment. I have done nothing wrong in my job. But my boss due to some personal reason has conspired all this. Can I file case in Labour court, as my job is clerical nature. Pls guide me. My grautity, PF, Earned leave is all held back by the company.

From the physicians, managers and employees of (your practice/business name here) by demonstrating total professionalism in the workplace with your dress, your demeanor and conversation. Represent the business/practice in a way that would make your Mother and your boss proud of you. Treat your co-workers as you would like to be treated.You have to follow employer command. In case of illegal termination only law will take action.
