Transfer of property

We are having our ancestral property in the name of my father and my uncle(dad's elder brother) who died in year 2000. Our land is still in my father's and his name. Now  we want to transfer the property in the name of someone from the Uncle's family. My question is who is the legal heir of the property and what is the procedure of transferring the property in his/her name.

Secondly, if we want to sell our portion of the property( half of the property) , can we do it if it is still in the name of my Uncle? If no, then whose signature/presence from my uncle's family is required to do so.

please reply at the earliest.

I want to know who is legal heir of the property after the death of a person? Is it the son,wife, daughters or all?

Sir, plz clarify one more thing that whether its mandatory that all of them must be present in the court/tehsil for signing the NOC or something like that or it can be done with presence of 1-2 persons from their family.
