USE OF STAMP PAPER

Sir,

Can a stamp paper issued in one person's name, be used by another person wtih the consent of previous.?

No. The consent does not work here. The stamp duty has to be paid by the either of the party to the document either of the party.

No it is not correct purchases - advocate is to make documents on said stamp paper of course he is authroised to purchase stamp papers on behalf of his client if authorised under vakalatnama or if given specific powers to purchase stamp paper. Stamp Duty are to be levied only from parties involved in transactions. If lawyer purchasing stamp on behalf of his client he has to sign stamp paper before stamp vendor on behalf of his client and also has to right "with athority" or "for and on behalf of". Parties involved in transaction has/have to purchase stamp paper and that way a right value of right Government duty is paid vide stamp papers to concerned State Government. Stamp papers purchased in one state also cannot be used in another state or in union territoary. Refer relevant provisions of Indian Stamp Act and Indian Registration Act.
