I want to file Execution Petition under section 27 of CPC at State forum. OP failed to deliver the flat in spite of flat is ready with the OC for building 5 months ago. OP has secured full amount of flat 9 years ago. State forum had issued the decree to deliver peaceful possession of flat including other remedies in 2014. The matter is sub judice at Appellate court in Delhi. During last proceeding, appellate court allowed OP for settlement with us after OP pleaded. I sent 2 notices to OP in this respect. But still OP do not deliver possession.
