Welfare society not acting against bye laws

Respected Seniors,

The Flat Owners Welfare Society is registered with the Registrar Societies under Rajasthan Act,1958.

It submitted its bye laws which were signed by the Registrar Office.

However, the Society Executive modified the bye laws.

But it is neither following the approved bye laws nor the modified one, in EC election or in incurring capital expenditures, e.g., it carried out elections without following quorum guidelines and continued to incur large capital expenditures without observing guidelines.

The Registrar office when apprised verbally,advises to lodge FIR or file civil suite.

civil suit can be filed in the civil courts where the society is existed.

As the Society is registered under the Societies Registration Act, the only recourse available is a civil suit.
