What are my rights after Termintion

Hi

One of my friend was an employee of Punjab State Electricity Board (PSEB). He got trapped in PC act in 1995. was suspended and then rejoined office till his case was under consideration. The case went on from session court to high court and then in Supreme court. Finally in 2011, supreme court dismissed the case and he is now in jail for remaining imprisonment. He was terminated by PSEB in 2003, just before 3 months of his retirement.

I want to know if he can get his Pension or Gratuity or yearly increments (which were pending since 1995) . If yes, how to proceed for the same.

There is a lot of difference between termination and dismissal. So, please check if your friend was rellay terminated and not dismissed, as in PC Act cases, I don't think his services would have been terminated.

 

However, if he is terminated (not dismissed) he can claim service gratuity for the period of his service and provident fund etc.

 

About increment, no increments are allowed for the suspension period, as only duty period and duly santioned leave counts for the grant of increments.
