WHO IS THE REAL MURDER IN THIS CASE, MONOJ OR POLICE?

Name of the characters:-

Manoj(accused);

Punam, Ajay, Vijay (three murdered children);

Shivlal (Father of the murdered children);

Shivnath (brother of Shivlal/ Uncle of murdered children/ beloved of Sumrit bai);  

Sumrit bai (Wife of accused Manoj/ lover of Shivnath).

Place of occurrence – Ratanpur, Dist – Bilaspur, Chattishgarh.

The case story

Shivlal & Shivnath two real brother resided at Ratanpur.

Manoj was their neighbor.

Shivnath & Sumrit bai w/o accused, fall into deep love.

Fewdays before Shivnath went to Jabalpur.

Thereafter on a sudden Sumrit bai left the home alongwith her two children without informing her husband - the accused.

They were at Jabalpur, but it was not known to the accused. However the accused guessed it and went to local police station for complain. The police station did not hear him. He came back and started planning to take revenge. It was in his mind that, Shivlal responsible for the ‘act & misdeeds, of Shivnath. On 11th feb 2011, the accused kidnapped the three murdered children, while they returning from the school. The distance between the school & home were about 1-1/2 km and some portion lonely area. The accused met them and offered the poor children, chocolate and samosa. The three children knew the accused as their neighbor, and happily went with him. Accused brought the children, in a very lonely place of that area and killed the brothers and sister, one after one brutally.

Thereafter the accused filed away from his village.

When the three children did not return from the school, Shivlal & his family started searching and at last they went to local police station for complain, but the police did not hear him and told him to come back next day morning.  In the mean time one villager Ashoke Patel informed Shivlal that he saw the three children along with the accused. Next day morning Shivlal able to lodge complain, and police started the investigation. Police rang the mobile of accused. He replied. Police traced the location and arrest him from her relative’s house. After some hardness accused braked and took the police at the place of occurrence. From that place, Police recovered the three bodies, school bag, samosa, chocolate etc from the place of murder.

Now Monoj is accused of the murder of three children, but the question is – who is really responsible for these three murders, Monoj alone?

Police refused FIR, very particularly, from the poor people. It is a very common practice in this country.  In this case, they refused twice, firstly from the accused, Manoj, secondly from Shivlal.

The people of Ratanpur and neighboring area are very much aggrieved on such shameful police activities. Now police placed Monoj as an accused of murder.

If police recorded the fir of Monoj in time, the grievances of Monoj could not reach so high, and the three children could save from murder. Now the question is who is the real murder in this case, Monoj or police?

Here is answer to your posting made in a wrong Forum (Famly Law) it should have been in Criminal Law Forum. This besides the point the answer is;

A Senior Govt. Officer orders one of his sub-ordinate jundior officer to come at sharp 9 AM next day morning.

The Junior does not come next day. Question is can this Senior Officer suspend him on that day?

Keep thinking you will get answer to your que.

In first instance Police cannot be accused because Sumrit bai was an adult and went according to her free will. Police cannot lodge false FIRs for "kidnapping" etc. Nobody kidnapped her and took her away forcibly against her will. In second instance after children were murdered police should have been prompt to register an FIR. I would also blame Shivlal for not educating his children to be alert, avoid company of anybody or eat anything from anybody especially Manoj. This is common sense precaution when someone is aware that he is doing adultery. Moreover children should also be taught extremely violent self defense skills to safeguard their lives, if ever a need arises.

as usual the police in this country are useles and lethargic if bribed or under pressure from politician or goons then only they work. Otherwise India is Bhagwan Bharose. No law for goons like police majority of criminals are from police and politicians

real min this case is police and they will never be on the right side of law see thousands of cases where they destroyed evidence for money like ruchika or lal cases

What Arup Sir, is trying to underpin is that, if the Police acted in time the brutal acts of butchering the innocent children could have been avoided, yes I agree with him on that score, burt however negigence the Police might have been, it does not give Manoj the licence to kill by taking the law in his own hand, through the negligence of the Police. At the most Police can be charged with derelications of duties. But Arup Sir, is absolutely right in fastening the liability on the Police also. I am of the view that Union Home Ministry should do something on such callous and supine slackness on the part of the Police, had they acted in time this unfortunate incidents could have been averted. Stringent actions should be taken against those Police personnels.

- Actually, shivnath done an offence u/s 497/ipc, accused manoj not aware of it. if he got sympathy from police station, his complain recorded, he might not have done the murder.

- before investigation it can not be said that --- these things happened.

when a person not found (a case of gumshudgi) in general police accept a fir, thereafter started investigation and put their findings recorded or the report placed before the concerned court for further action.

- in case of 497 police can not file a case directly, manoj the accused had the right to complain against shivnath u/s 497. but as monoj did not know the law properly, instead of being a complainee, he turned into a murderer.
