Working hours in bpo industry in gujarat

Hi,

I am working in TCS in Gujarat. Here in this company I am being forced to work for 9hr and 45 mins(45 mins is a break), 5 days a week.

Now I read one notice displayed in the office by the corporation stating that " the working hours should be 8.30 hrs and 30 mins of break, so it comes to 9 hrs daily."

Now I follow the second one, the one which Corporation displayed. Now is it ok, am I following the rule? Do company can take legal actions against me for not following their policy?

AND WHICH ONE IS THE RIGHT POLICY EITHER TCS ONE OR CORPORATION ONE??????

BPO/KPO are covered by ( name of the state) Shops and Commercial Establishments Act.

Work hours, OT, rest time etc  are also stated in ( name of the state) Shops and Commercial Establishments Act.

Gujarat followed Bombay Shops and Commercial Establishments Act and has placed Gujarat Shops and Commercial Establishments Act………………………..on website of Dept. of Labor.

Work hours are:::8/day=48/week. Beyond it OT is applicable. Beyond 9hrs/day OT is applicable.There is a limit on OT hours too.

The notice of corporation should mean 8.00 hrs excluding 30 min. break.

Neither corporation nor your company is wrong……………………….since your company works 5days/week.

How do you handle it is up to you.

There are many IT/ITeS employees unions, including for female employees too and trade unions like CITU/INTUC/AITUC/BMS …………………….are willing to embrace them……………….
