Wrong jurisdiction in civil case in gujrat - remedy

I Have filed a civil suit for specific performance at Surat Gujrat.

It has gone to Senior civil Judge but the valuation is only ONE THOUSAND RUPEES so it should have gone to lower court.

 

Now what is the remedy.

Matter provided is unclear.

But if a suit is filed in a court having no jurisdiction then upon scrutiny the suit will be returned and will not be dismissed so need not worry.

If any court has no jurisdiction to try and decide the civil suit then the court cannot dismiss the suit on account of jurisdiction but has to return the suit u/o 7 r 10 of cpc..

There is typical situation now in Gujrat. All classification of judges have been changed and what are their powers is not available any where.

New structure is-

 

1- District Judge.

2) Additional Dt Judge.

Any advocate from Gujrat and pl give information in this matter.

3) Chief Juditial magistrate.   THESE CATEGORIES EXISTED EARLIER AND SAME EVERY WHERE.

New categories in Gujrat and probably in UP.

Sinior civil Judge and ACJM

JMFC.

ASST CIVIL JUDGE AND JMFC.
