Abrtion why illegal always?

(Querist) 20 September 2008 This query is : Resolved
Sir/Madam,
In a country where death sentence is still awarded by the honourable courts then when can't we have abortion after 20week of pregnency when we know that the child shall never lead a normal life and that the mother is ready for abortion? Do we believe in painful death rather than peaceful death? Looking to European countries we find cases of MEARCY KILLING, then can't we grant abortion on medical grounds (physical handicap)?

Is the life of a child in a womb come under Art.21 of the Constition?Has the physically handicapped peoples have a right to die in any law?
Rajesh Kumar (Expert) 20 September 2008
Well shine is very correct.
It all depends upon a definition of life. Does a life starts after delivery or after conception.
Under old Hindu Law, a child in womb was traeted as a coparcener and has a right to hold property, share n everything.

Sorry Anindita, but you seem to be a very hard-headed woman!

Anyway, if there is a growing 'radical' consensus among us Indians in this matter then the Parliament may be compelled to review the existing law.
