Are you Hindu?
Your brother in law is already having a male child.

If you are a Hindu, "for Adoption if any adoption is of a son, the adoptive father or mother by whom the adoption is made must not have a Hindu son, son's son or son's son's son. it applies to a daughter also under Hindu adoption & maintenance act.

Beyond it you may consult with your counsel, in detail.

Agreeing with above I would like to add that one cannot adopt the child of someone whom he could not marry.
