G. ARAVINTHAN (Expert) 28 March 2010
more details needed. What are all the properties you father left?
if there is any will ?
Parthasarathi Loganathan (Expert) 28 March 2010
Since it is a share of inherited property of your father, being a daughter you are legally entitled to share the same. As Mr.A.Ganesan had opined, it all depends upon the Will executed if any by your father.

As your father's property is ancestral, you have one third share in the property. It is running right and even if twenty years has passed, it is not barred by limitation. There need not be a Will.

Issue a legal notice to your brother and initiate partition proceedings in civil court. Family Tree, Death Certificate, Partition Deed (executed earlier by which your father got his share) etc. are the documents required. All these documents you would get from revenue authorities.

You being the daughter you will share with two sisters one-third of your father's property.File suit for partitioning of property since the property is ancestral.
