Ownership Property Dispute


My father (died on 31.12.08) purchased a small house in the year 1966 in a village. The sale deed was prepared on plain paper with thumb impression of the seller (dead) and signature of two witnesses (one dead). The sales consideration was Rs.600/- only. On the basis of this transaction, the ‘Gram Panchayat’ registered the name of my father as the owner of the said property on the government records. This continues as on today also, but my real uncle filed a case in the court in May 2008 stating that the said ‘sale deed’ is not legally valid since it is made on the simple paper and not on the ‘stamp paper’ and it’s a document singed by coercion and cheating. By notarized will, the said property is transferred in my name after the death of my father.
Now, what is my legal position and how should I protect my legal right?
Please advice me.

ANCESTRAL HOUSE

I HAVE AN ANCESTRAL HOUSE WHICH WAS MADE BY MY GRANDFATHER. HE MADE THIS AS PER MAP (NAKSHA)APPROVED BY COMPETANT AUTHORITY. AFTER THAT HOUSE TRANSFERRED TO MY NAME AND I DID SOME RENOVATION/ ALTERATION IN BUILDING WITHOUT TAKING PERMISSION OF ANY AUTHORITY BECAUSE I WAS NOT AWARE. NOW "THE PUNJAB NEW MANDI TOWNSHIP ASSOCIATION" HAS SENT ME NOTICE THAT MY HOUSE IS MADE ILLEGALLY WITHOUT MAKING AND APPROVED MAP. AND TEY HAVE CHARGED ME WITH ARTICLE 13/4 OF 1960.
1) CAN I GET MY MAP APPROVED NOW OF RENOVATED HOUSE, IF YES, UNDER WHICH CLAUSE.PLEASE HELP.

Ancestral Property

Dear Lawer,

On March 3rd/1996, My mother brought a plot with GPA( General power of attorney) from a Vendor (56 years old) and at that time the vendor had 3 sons and all were Major, but they have not signed the GPA.
On 15 Dec-2003,my mother registered the same property to my name as an Attorney Holder.We have 3 shops from past 4 years and all the taxes,electricity bills etc are in my name.

Now, the 3 sons of the Vendor are threatening for randsome,else to book a case against us?

Could you please advice? I heard that after 13 years,they do not have any rights

LEGAL DOCUMENT

Reliquishing of immovable property inherited by legal heir to co-owner through a registered DEED OF RELEASE/RELIQUISHMENT. Q 1. Is it legal. 2. Does it transfer right ,title and interest. 3. Is it in any way legally less binding then a SALE OR GIFT DEED. 4. Is the law same for the country or different for different states in this particular matter. Thanks

public premises

i have a client who has approached me he is a household servant in the government office. he is doing this since generations since the year 1960. they are provided with houses to stay by the govt. the payment of rent and salaries are not prompt. there is no documentary evidence to say that the person is a tenant there or any kind of ownership. the authorities concerned are not very keen to solve there problems. they have correspondence made with the authorities. they have their names on ration card. payment of electricity bills not done at regular basis. now at this stage the action is required as the authorities are now upto demolish the same. and my clients are not in a financially sound position to afford another house. they are very poor people and hence approached me to help. kindly let me know how can i approach the court for reliefs.

plots sold on false POA




I purchased a plot in 2002 from owner by regd. sale deed and got ferfar and 7/12 in my name i paid NA tax of plot in 2003 and 2005 now present patwari says plot is not in my name it is in the name of some one else who purchased it from POA holder one month before me. but in his sale deed no copy of POA attached neither any registration no. of POA mentioned. my query is how 2 patwaris gave me 7/12 and recd. tax from me.present patwari says false 7/12 have been issued by 2 previous patwaris . ferfar is there but in 7/12 abstract my name has never been put.I am surprised how can 2 patwaris issue false 7/12 and collect taxes from me and why ? since3 patwaris are involved in this case I have filed an appeal before SDO for cancelling ferfar and 7/12 of other buyer and take action against patwaris and other buyer . Is it right procedure ? or should i file criminal case against seller? what should i do ? I thought to save their govt. jobs patwari will come for settlement and my problem will be solved. moreover POA holder has assured me to give plot some where else in lieu of this plot I agreed for this settlement and agreed to pay the diffrence of 2 plots which came out to be Rs. 44700/- for which he has taken 10700/- from me and given me a bayana receipt (ISSAR CHITHI) on 100/- stamp paper having accepted to receive entire amount (my old plot value and 10700/- ).but now he is not executing sale deed .I sent him legal notice but no reply in first case I have filed appeal with SDO .Hence patwaris and other buyer are pressurising him to execute my sale deed but since he has to pay money to his partner which I have paid him and adjustment money of the earlier plot , so he is delaying the sale deed . when ever I ask him to execute sale deed he just says wait for few days though he doesnot deny but he is prolonging . I am fed up. i think they donot have any power of attorney patwaris and subregistrar all are involved in this racket. now what to do in this 2 cases ? my email add. rameshgajwani@rediff.com

PIL by public servant

Can a serving public servant file PIL against vexatious litigation being indulged by the Department he is serving? The grounds proposed to be highlight are that the facts are incomplete, misleading and false and the laws, misstated.

where right of pre-emption or first offer doesn't arise

sir,
i want to know that in case of dwelling
house if there is partition of property between two brother who have aquired it through separate sale deed from their father
in lieu of money and now one of the brother wants to sell his portion to a third party ,then is there any right of pre-emption or first offer arise for the other brother?they don't share good relation.

urgent help required.

Regarding equal share of daughter their father propeties

As per hindu law whether daughter is having equal share in her father's own earned movable & immovable propeties?
