Sir,
I am a wholesale paddy trader from Gondia,Maharashtra.
A person who bought 5 truck of paddy from me has given me a cheque of Rs 5lacs.
But it is dishonoured by his banker with reason "the payment is stopped by the drawer".I sent him a notice through my lawer.He replied that the cheque was missed and he has also done a FIR in the police station.Now what is the way to recover my money.Please suggest me.

My mother-in-law has two house properties in her name.One house is at the heart of city (where she is residing along with my father-in-law)and its market value is Rs.40 lakhs.Another house is at suburban town and its market value is Rs.6 lakhs.My mother-in-law got these properties through the will of her mother(who is not alive).
My mother-in-law has 3 sons and 3 daughters and they are all married and settled.I request for legal reply for the following queries:
1. My mother-in-law wants to execute a will giving Rs 40 lakhs worth house property to her 3 sons and Rs 6 lakhs worth house property to her 3 daughters.
Can she write such a will on her inherited properties?
2.Can the daughters claim equal sharing of both the properties along with their brothers and ask their mother to execute the will to that effect?

IF AN INDIVIDUAL'S ACCOUNT ( TO BE SPECIFIC CREDIT CARD ACCOUNT) WITH ANY BANK IN INDIA GOES INTO SOME PROBLEM AND ULTIMATELY BOTH PARTIES ENTER MUTUALLY INTO A FULL & FINAL SETTLEMENT.
AFTER THIS FULL & FINAL SETTLEMENT THE INDIVIDUAL PAY THE AGREED AMOUNT AND THE
BANK ISSUES HIM A SETTLEMENT LETTER MENTIONING THAT NOTHING IS OUTSTANDING ON HIS ACCOUNT.
CAN THE BANK SHOW STATUS OF THE ACCOUNT AS A WRITTEN OFF ACCOUNT IN ANY OUTSIDE AGENCY.
MY VIEW IS THAT THE ACCOUNT IS A SETTLED
ACCOUNT AND CANNOT BE TERMED AS WRITTEN OFF ACCOUNT.
PLEASE ADVICE IF POSSIBLE WITH THE ACT WHICH IS USED TO DECIDE THIS POINT.

My father owns a flat in Mumbai in a residential Co-operative Housing Society . We've been approached by a builder to redevelop the building . We've an option to go for extra area & we've to pay the builder as per the extra area we want to buy . I want to know -
1)Although the property is in my fathers name , can I avail of a home loan for the extra area we want to buy .
2)If No , can I become a joint owner & then avail of loan . How do I go about becoming a joint owner .
3)I've just been deputed to USA . Can I become a joint owner by registering the property in my fathers name & myself . I can issue a Power of Attorney to my father to sign on my behalf .

1. Should all the heirs sign in the document of Power of Attorney?
2.Is it necessary to register the document of power of attorney for selling the house?
3.Should all the heirs come once again to the Registrar's Office to sign the Sale-deed document while selling the house?

i got married last june in my native town. both of us are doctors by profession .she lived with me for a period of two months only.in sep 2007 she left me and living separately til now. she made simple things become big quarrels every day in those two months . she used to threaten me that she will commit suicide often . she is very much egoistic. her father and elder brother are lawyers by profession. thay came to my pklace on the day of separation and dealt with us in a aggressive way.. i and parents were verbally abused and got rash comments.rthey also told us that thay are capable of doing anything as they are lawyers. after 2 monthe i called her over phone.talked with her for an hour. she was not interested in talking with me. answered in mono syllables. finally she said that she she will reply that night. but didn't. till now there is no communication from her. she has also chanmmged her mobile no.now aftre all these harassment i am at the decision to bget legally sepsrated from her. please provide me the needfull advice
