employment of provate security agencies

Dear members

I am working in a PSU and I wish to ask:-

1. whether it is mandatory to outsource the security guards from the Directorate General of Resettlement.
2. We are paying as of now Rs 8650/- which is much more than prevailing minimum wages rates in Delhi. Are we supposed to increase our rates every time the state government increases their rates.
3. The DGR sponsored agencies are not passing on the benefits to the guards how to force them to ensure that they follow the government instructions.
4. The rates asked by the DGR sponsored agencies are very exorbitant as compared to the normal security agencies in the market.

Clarification on Employee agreement

hi All,

I am a Software Engineer. As part of the employee agreement, my company has a clause during terminating one's service from the organisation:

Subsequent to the termination of employment, no Employee shall directly or indirectly:

iii. For a period of 1 year from the effective date of termination of employment, commence or carry on any business that directly or indirectly competes with the business of the Company;
iv. Seek employment or get employed with any of the Company’s clients, business partners, Affiliates, or vendors.


Is the above mentioned clause applicable in the court of law?? becuase if i am a software engineer, i can only join another company which is in a similar trade. could you pls clarify?

mother harass by her son's

helo sir,plz solve the case
father of five daughter & two son died in 2000.he will his all property to his wife mother of all children.three daughter married when he alive and one was married after his death mother sell one plot for the marrige rest one plot,one shop which oprate by the mother and one house where one daughter and mother lived is in the possession pf mother.both two son lived separately since 9 years.but now they want partition(8)part of the property but mother don't want to do this because in house she & her daughter(unmarried) lived in that and also don't want to sell the shop because the expence of the home come from the shop oprate by mother and also don't want the plot because if she sell it than no son help her in the marrige of the rest daughter.
now the both son's file suit to partition of the said property.
what remady she has against her son's in the suit filed against her & and all the daughter's.

plz find the suitable solution of the problem.

divorce case

hello sir,plz read this very carefully and give suggation..........
i got married 13/5/2005 work in meerut.after some time i got T.B(disses)my wife live with me at that time.but know about my disses she call her brother and go to her home.she lived with me only 40days.24aug2005 my elder brother died accidently she come with her brother and go back second day after crimination.till now she don't intersted to join me.i file asuit against her under sec.9of hindu marrige act.she never come the court and case judgment go in my feavour.in between she filed a suit against me and my family under sec. 498A,504,506&323 in her home court.my father and me send to prison.my father lived there 13 days & for me it was 37days longer.after some time she file a another suit against me under sec. 125crpc.for maintinance.more than 8 mamber of her family in the same court due to this reson they always created big problem for me and my family.i send a copy to her and a copy in the cout where she file the suit against me in that judgment court order that she came back and lived with me.till now she is not intersted live with me.i am doing work in life insurance co. my salary is about 18000/-and now i am fit& fine.
now i am also not intersted in this relation . i want to divorce her and marrige to another girl.


plz give me your valuable suggation to me how can i take divorce from her because she don't want divorce me without any sufficient reson.

Repayment of money

Sir, what is the libility of a person for repayment of money on cheque bounce? When period of limitation begins? Whether presumption U/S.141 of N.I ACT,1981 is rebuttable, if signature has admitted already?

whether father is entitled to sell the property acqiired in succession or through inheritance from his faher without taking consent or no objection from his surviving children and wife?

Hi all,
My friend Grand father was the original owner and pattedar for Ac 11.00gts of agricultural land, and my friend grand father had only one son i.e My friend's father who is habituated drunker,Now recently My friend's grand father expired, thereafter In succession and throgh inheritance My friend's father became owner and possesor of afore said agricultural land and got mutated the same in his name and obtained patta in his favor, Now My friend's father is intending to sell the aforesaid agricultural lands without knowledge of his family members i.e to his sons, and to his wife.
Now My question is 1) being grand son whether My friend will get any share in the afore said property?
2)whether My friend's father is entitled to sell the aforesaid agricultural lands in favor of third parties without permission or by Not obtaining no objection from his surviving son and his wife,
3)and further if he sells the property without Knowledge of his son and wife, can his son and wife challenge the same.
4) finally for what remedy they can approach the court.

Hindu Succession Act sec. 6,8

'B'died in 1972 &left behind 'S' & his three sister & property &mutated in name of each in 1973-74 'A'son of born in 1977 & 'S'transferred his 1/4 share in 1985-Transfer made by 'S' .can be challenged by 'A' because property devolved as per capita & not per stirpes.what cases law S.C.about it.
