Request to help for guidance, comments

Sir/Madam

I have great pleasure in introducing myself to you. I am pursuing Post Graduate Degree in Master of Business Law (M.B.L.) from NLSIU, Bangalore in distance education mode for session 2008-10.

As a part of this course, the students are expected to write a project, to get experience in practical work with a view to equip the professionals with the skill and knowledge which is current and contemporary.

Following are my topics to write projects:

1.CONTRACT LAW: "Arbitration" - A General Study of Legal Provisions (along with Cases)"

2.BANKING LAW:"Debt Recovery Tribunal"

3.CORPORATE LAW: "Take-overs - A Critical Study"

4.INDUSTRIAL RELATIONS LAW: "Adjudication of Industrial Dispute - A Critical Analysis"

5.ENVIRONMENTAL LAW: “International Environmental Law and its Compliance at the Domestic Level”

Project work required its Introduction, explanation of the existing systems prevailing in other countries as well, approaches by the Courts along with legal provisions and cases, comparative study of foreign law and cases decided by Courts in other Countries. More importantly suggestions like change/ amendment if required in present law or system, are mandatory to be mentioned supported by data statistics, survey, filed work if any.

In the instructions, we (students) are strongly advised to go beyond the course materials, to contact, discuss and receive any help, guidance from any knowledgeable persons.

It would be a great help to me if I get your valuable help, guidance, comments on any of the project topics mentioned above. Strict confidentiality will be maintained whatsoever as per your wish. You may refer me to your knowledgeable friends.

Electricity Act

My client is an 80 years old man, he has got lot many properties and monies, however his health does not permit him to look after his investments.Therfore, he takes assistance from 2 girls-one as share analyst and one accountant and asks them to invest in Shares for himself only , for which he has got 3pcs at his residence. Here it can be noted that he is using his resience only for residential purpose. But my client received a notice u/s 126(1) of Electricity Act 2003, from BEST(supplier of electricity in mumbai) alleging that electricity is used for commercial purpose and therefore they issued a show cause notice stating their intention to change tariff from residential to commercial.we have replied their notice and explained them above fact that he is using his residence for residential purpose only and not commercial purpose as the investment is done solely of his investments and thereby no commercial activity is carried out.I need a suitable judgement which can support my above contention-pls guide me with the citation.Thanx,BinduAdvocate

REPLY FOR RTI

My one of the friend was serving with an NGO of disabled persons, this is not running under any government grant, donations, but running only the membership of of disabled persons.About 20 years back, district administration has granted some 7.50 acres of vacant land to this NGO to set up Vacational Rehabilitation projects, but due to high politics the then office bearers could not able to set up the project and got the land idle, due to this the entire land was taken back by the district administration and the proper records was not available with that NGO. Meanwhile one of the disabled member made an application in the name of GENERAL SECRETARY of the association [Present General Secretary was only new to this NGO as he serving general secretary for the past 4 yEARS] under RTI act along with Rs.10/- postal order to produce the documents of aforesaid land alloted to that NGO during 20 years back.

Please ascertain whether the innosent General Secretary should bound to reply that RTI application and what is the procedure to return back that postal order submitted to NGO.

prevention of creulty to animal act & Animal preservation act

Animals are seized from the truck , there was no permit for carriying the cattle & without complying the neccesary provision of law. The accused has filled petition to take interim custody of cattle pending inquary . The pajarapole has a rights to be heard before passing any order by judicial megitrate if yes under what law ? as an advocate of welfare body like pajarapole do not want to give inturim costody to bucher .what should be the arguments.

Can employee Advocate practice in the court? If his duty as an part time job?Then what is the procedure about his enrollment any provision regarding the advocate act plz. reply?

Agreements


Respected All,
I would like to ask what one should keep in mind while drafting Amendment Agreements in accordance with previously signed forms.And,To work on Agreements to add funds to umbrella agreements.

Please guide me and one more request if any body having the soft copy pls, share.

My question on RTI Act

Dear Friends,
Can the information collected under RTI Act be used as evidence against the organisation from whom the information is collected? My second question is if a person keep on asking information about already taken details can the organisation refuse to give and sue the person? If so on what grounds? Please advice.
