Can a spouse member get guests in the gymkhana?

(Querist) 29 December 2015 This query is : Resolved
Respected Panel,
This is to invite your kind attention that Iam a spouse member in one of the reputed Gymkhanas in Mumbai.
As a spouse member and as per the bye laws I was enjoying all the benifitial of the gymkhana except voting and attending meetings.
Just recently I was stopped getting a guest of mine in the gymkhana premises as I was told that a spouse member cannot get guests.
On going through the bye laws it clearly mentions that a spouse member shall enjoy all the facilities of membership during the tenure of the membership of the member and shall be allowed to play any particular game on payment of the departmental fees fixed by the management committee from time to time.
They (spouse of the member) shall however no right to participate and vote nominate or contest any of the election or by election of the gymkhana or participate in the proceedings of the general body meeting.
In this case then why was I stopped from getting my guest in the gymkhana?
Please if any one could help me in this regard and oblige.
Vinit

Hi,
Ask for any specific clause by which they have an authority to stop you from getting your friends there... Any clause or any amendment or any resolution made recently..
This is an internal issue of your club and the bye laws are made by the members and the board.

Sir just enquired with some gymkhana authorities and they have confirmed that no amendment or resolution has been passed in this regard till date.

Write registered letter to managing committee asking reason and lodging complaint.

Well, meet the committee members and bring this to their notice. If they resolve your issue then it is fine. Else you have to initiate proceeding before the Registrar of Society.

These are part of internal regulation of the concerned organisation . Sometime the management takes certain decision with the consent of majority members as per provisions of bye-laws which is respected to by members and beneficiaries in larger interest of the entity. Pl. get your query clarified from the management in charge before planning any legal action.

At the outset let me thank the expert panel for enlighting me on the ongoing gymkhana dispute which Iam undergoing.
In light of the above I would like to place the following facts for your kind perusal :
1. That there has been no change in the amendment nor has a resolution been passed to this effect.
2. I became a spouse member in 2002 and it's just last month that one particular committee member took objection to me bringing guests
3. Some years back there was a tiff between me and him on a game of billiards and that could be the reason he may have vented his earlier grievience on me.
4. I have written a letter to the General secretary and I have received a letter from them that they are taking up this matter in the next committee meeting.
Will keep the panel informed on the next development
Thanking you
Vinit
