Can anyone please tell me that

If a magistrate take a cognizance in an offence can he take another cognizance on the same offence and on the same accused??

if there r two separate cases The magistrate can. But if there is a single case he cannot.

if the parties in the case are same and the offence again occured in the same parties than the magistrate can take the cognizance in the same.

as such a magistrate takes cognizance of an offence............but once he takes cognizance he cannot take re-cognizance or amend cognizance as it would amount to review of previous order and it is settled that criminal court does not have review powers....refer to adalat prasad's case
