Death compnisatory job in harness.

(Querist) 06 February 2010 This query is : Resolved 
DECEASED DIED WHILE IN SERVICE,HAVING TWO WIFES.

First unemployed,having major daughter.

Second WIFE working as conductor had a son now(after death of deceased)became major.

Though providing job in harness to the diseased employ family as matter of right the department is willing to provide job.

No understanding between wives of deceased like wise the children.

1st wife daughter completed 10+2 and appearing degree final in distance education.
Second wife son now in 10+2 final.
both are willing for jobs.

Who are the fit persons to get job as per law.

Son is preferred compared to daughter in such cases but there is no specific law in this regard and it depends on the persuasion by individual.

First of all, providing employment on compassionate ground to dependents of an employee dying in harness is not at all a matter of right.Pepsu Road Transport Corporation Vs. Satinder Kumar & Another 1995 Supp (4) SCC 597 and (ii) Umesh
Kumar Nagpal Vs. State of Haryana and Others (1994) 4 SCC 138.

Secondly, it will depend on the Rules of that concerned department whereby the service of the deceased employee were governed as to which dependent will be entitled and given preference.
