Eviction of tenants under transfer of property act (sec 2(3)(g)

Sir
I have given an commercial premise on an monthly rent basis measuring 250 sq ft, (23.22 sq meters).
Our agreement for 11 months agreement,. Now due to some problem I want to evict the tenant from premises by filing a suit for eviction.
I want to know
(1). Is it good for me to file a case under Karnataka rent act 1999(mine is 11 months rent agreement)
Or to file a suit under transfer of property act. Sec 2(3)(g).
Which is best for me ?
(2). Also I want to know is it ne essary to give ground for eviction in case of suit filed under transfer of property act sec 2(3)(g).

what are terms of your agreement .it must be providing for issue of notice .after issue of notice if tenant doesnot vacate then file suit for eviction

According to the terms of our agreement we have to give one months notice to the tenant for eviction.

issue notice . wait for his reply . then fiile suit for eviction after expiry of one month if he dosent vacate

If you have indicted him as a tenant you can bring suit for licensee.
You have to bring eviction suit under the local Rent Act and without mentioning the ground fir eviction your suit would not lie.
