My wife has applied for EWS certificate and was issued the same. At the time of issue of certificate my Income and assets along with Assets from wife's father father were taken into consideration.
We had applied for EWS certificate after 2 months of her father's death. But now there has been enquiry on the same certificate and the tehsildar is asking to provide the income details of her father (for the FY when he was alive) also and threatening to cancel the certificate on the grounds that his income plus mine makes it more than criteria. Her mother has already passed away 15 years back.
Kindly advice is the Tehsildar right in considering her father's income.
Although me and my wife are living with my parents and we have got married many years ago.

he Karnataka High Court ruled that the caste of married women applying for government jobs should be based on the caste and income certificate of their parents, not their husband's.
To be eligible for the Economically Weaker Sections (EWS) quota for government jobs and educational institutions, a married woman must meet the following criteria:
The annual family income must be less than Rs. 8 lakhs
The family includes the person seeking benefits, their spouse, children, parents, and siblings under 18
Candidate's annual family income must be less than Rs. 8 lakhs per annum.

Yes. The Karnataka High Court while hearing petitions filed by the married women challenging the action of the State held that the caste of married women applying for the government job must be considered based on the caste and income certificate of her parents rather than the husband’s.

In order to issue EWS certificate to a marrried woman income of her husband shall be considered, please recheck the order of Tehsildar.

Thanks for reply. But we have already given the Assets and caste from my wife's parental side. We both belong to general category.
They have taken my income into consideration and we have our own Family. And at the time of applying both her parents had Expired.

The period of the certificate may pertain to the period when her father was alive.
You have been explained about the law involved in this, hence instead of asking any further irrelevant questions and wasting yor time here, if yo feel that yo are right then take legal action agaisnt the Tehsildar by making a complaint against him for his non updated knowledge in this regard, before the District collector for relief and remedy
