A person-X is alleged for making fake facebook account of his wife. The computer and internet connection used for the activity is on his brother’s name-Y but, his brother-Y does not know about this activity done by a person-X.
1.Do the cyber crime law or Section 66 of the IT act, 2008 implicate to the brother-Y of alleged person-X?
2.Under which section/Act police do arrest of the brother-Y of the person-X?

Ans. 1 As per IT Act brother is responsible.
Ans. 2. Every crime has a motive, during the investigation if the motive becomes clear to the police after interrogating Brother -Y The husband will be the one who will face the brunt as an Accuse not the brother if he is innocent & has no knowledge that his computer is being used by the brother for malafide intention, but if he had the knowledge then he becomes co-accused or a conspirator U/s 120B IPC he may be arrested accordingly.
