Does daughter have rights after marraige to house and all

(Querist) 23 February 2013 This query is : Resolved
Hi, i want to know if a married daughter has legal rights to her parents house and investments. Parents have died interstate, and succeeded by two brothers. Father having joint account with elder son. Daughter has made herself nominee in her mother's account. And also what are the legal rights of the younger son and his own son according to the hindu law and constitutional law. Can the daughter force brothers to sell the house and claim any part of investments??
Appreciate your time, thanks in advance.

since parents died without making any will all children have equal rights on parents property . she should first try to amicably resolve the issue with her brothers .if property is located in mumbai you would need a succession certifcate in name of the children .
if talks fail then proceed legally .

As your father died intestate then rights of all chidren including your mother arises and all of them have equal share in property. Try to settle down the matter amicably with your sister and get a succession certificate.
